Terms of Use
The terms governing your access to the StormwaterIQ website and the evaluation of our products and services.
1. Acceptance
These Terms of Use ("Terms") govern your access to the StormwaterIQ website and any preview, evaluation, or unauthenticated portions of our service (collectively, the "Site"). By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.
Use of the StormwaterIQ platform under a paid subscription is governed by a separate written agreement between StormwaterIQ and the subscribing organization. Where that agreement conflicts with these Terms, the agreement controls.
2. Eligibility
You must be at least the age of majority in your jurisdiction and capable of forming a binding contract. By accessing the Site you represent that you meet these requirements.
3. Permitted use
You may use the Site for lawful purposes — to learn about StormwaterIQ, request access, communicate with us, and evaluate our products and services. You may not:
- use the Site in violation of any applicable law or regulation;
- attempt to gain unauthorized access to any portion of the Site or related systems;
- reverse engineer, decompile, or otherwise attempt to derive source code, except to the extent that applicable law prohibits this restriction;
- use the Site to transmit malware, conduct denial-of-service attacks, or interfere with its operation;
- scrape, copy, or republish the Site or its contents at scale without our written permission.
4. Intellectual property
The Site, including its design, source code, documentation, copy, illustrations, and trademarks, is owned by StormwaterIQ or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for the permitted purposes above. All other rights are reserved.
5. Submissions and feedback
If you send us suggestions, ideas, or feedback, you grant StormwaterIQ a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction. We are not obligated to keep submissions confidential unless we have signed a separate written non-disclosure agreement covering them.
6. Third-party content and links
The Site may reference public regulatory datasets and third-party services (for example, NOAA, USGS, EPA, MapBox). We do not control those sources and are not responsible for their availability, accuracy, or content. Linking from the Site does not imply endorsement.
7. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMWATERIQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Information published on the Site is for general informational purposes only and does not constitute engineering, legal, or regulatory advice. Hydraulic computations, BMP recommendations, and permit references intended for production use are available only through the StormwaterIQ platform under a customer agreement and require professional review.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMWATERIQ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify and hold harmless StormwaterIQ and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your breach of these Terms.
10. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination will survive.
11. Governing law and venue
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of these Terms is the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits any right you may have to bring claims in your local consumer-protection forum where required by law.
12. Changes
We may revise these Terms by posting an updated version with a new effective date. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
